General Terms and Conditions of Italian Shoe Factory L.L.C. – Repair and Restoration
I. TERMS AND CONDITION OF ITEMS TO BE REPAIRED BY ITALIAN SHOE FACTORY L.L.C. (Company)
- The Company usually perform the service within the lead time communicated to you, however delays can happen due to unavoidable circumstances, and we will not be held responsible on such occasions. In case of delays, you will be notified over the phone, message or by email.
- The Company might need to contact you for clarification or approval of a service to be performed. The Company will not be held responsible for any delay in the service lead time if you cannot be reached out during the process to get approval from you.
- Any additional repair work requested after the final tax invoice, will have additional charges, and will be invoiced accordingly. The Company reserves the right to accept or not to accept the additional repair work.
- The Company is providing repair and restoration services with the highest possible care and expertise. However, the company cannot predict how the leather/suede/fabric and other materials will react to cleaning, dyeing or treatment, and the result will depend on the initial condition of the item. There is no guarantee that all the stains and scratches will disappear nor that the color shade while dyeing will be totally even. The Company cannot guarantee to match the exact same color shade of your choice or the original color shade of your item when we provide recoloring services, but we will try our best to go to the closest match.
- Leather being a natural product is not consistent in absorbing colors and treatment throughout the surface evenly, hence there is always a possibility of color shade and shine/matte differences. Softness, texture and overall feeling of the leathers and fabrics may also be affected after recoloring and treatment. Therefore, it is NOT possible to achieve 100% same color shade, texture, softness, shine/matte and feeling of the original or a brand-new item.
- Stains on materials such as velvet, satin and canvas/textured/cured/printed/exotic leathers are needed to be cleaned thoroughly. In this process, loss of texture, color, grains, and prints will be affected or flattened.
- Metal accessories or hardware of your items will be cleaned thoroughly, but some scratches cannot be removed and may not get the same shine of the original or a brand-new item.
5. Please check and remove all the valuables including money, jewelry, dust bags, gadgets, or any proof of authentication such as stickers/labels/cards/tags of the brands. We will not be held responsible or liable for the loss or damage of these valuables.
6. An agreement between you (client) and the Company (Italian Shoe Factory L.L.C.) to restore your items, such as bags, shoes and any leather goods on your behalf comes into existence as soon as you sign this agreement. Such agreement being governed by these terms to the exclusion of all other terms and conditions and representations, whether written or oral. By giving an item to us, you are confirming you are the rightful owner of the items in question, and you have given full authority to the Company to repair and restore the item without anyone else’s permission or both parties understood that you have obtained any necessary permissions. You will maintain ownership of the items throughout the process.
7. In the unlikely event that an item becomes damaged whilst in our care, the liability of the items shall not exceed 10 times the repair cost and will not exceed AED 1,500 regardless of brand or condition unless previously agreed in writing between both parties. If you are unhappy with any part of the completed work, you have 48 hours from return to contact us. We will investigate any complaint promptly.
II. REPAIRED ITEMS REQUESTED TO BE DELIVERED AFTER THE SERVICE.
1. Upon request for delivery, the company will facilitate on your behalf, the transport of your items from our workshop to your given location. While we carefully select and monitor our logistics and courier partners, while the items are in transit, you are also bound by the terms and conditions of the company’s logistics and courier partners.
2. We reserve the right to leave parcels with a doorman, building, hotel or office concierge or other authorized people. We won’t assume any responsibility for any items lost or damaged while in their care.
3. On some occasions, our partners may refuse to delivery your items if they are of the opinion that the shipping address or the accepting party presents a risk to either their person, their equipment or to the item being returned.
4. If delivery is delayed by any event outside of our control, we will contact you as soon as possible to let you know and will take steps to minimize the impact of the delay. However, we are not liable for delays caused by external, natural, and unforeseen events.
5. The company may have to refuse delivery of fragile items and items with value of more than AED 5,000, therefore the company may request for you to collect these items personally.
III. COLLECTION OF ITEMS
1. Serviced items must be collected within a period of maximum 3 months from the items ready date. The company will not be held responsible for these items after the mentioned period.
2. Additionally, the Company reserves the right to start charging for storage fees for uncollected items for 3 months and above. Our storage rates are AED 100 per item per month, which equates to AED 3.28 per item per day. We will make attempts to contact you via calls, messages, and emails. If repeated attempts to do so have been unsuccessful, then we reserve the right to dispose the items without being held liable or responsible.
3. By using the company services and thereby accepting these terms, the customer forfeits his/her claim to the product and or the damages after the stipulated 90-day notice period. No refund on the service or value of the product will be made after this stipulated 90-day notice period.
